Welcome to Dramamint!
By accessing and using the services provided by Dramamint through the Dramamint website (including but not limited to dramamint.app and any domain names pointing to such website) and the iOS and Android mobile applications (collectively referred to as the "Dramamint App"), you acknowledge that you have read, understood and agreed to be bound by these Terms of Use (hereinafter referred to as the "Terms").
If you do not agree to any provision of these Terms, you must immediately cease the registration and use of the Dramamint services. These Terms apply to all websites, applications and related services provided by Dramamint. These Terms shall be legally binding on you whether you use the Dramamint services free of charge or for a fee.
Terms of Service for Dramamint
1. General provisions
1.1 Service Provider
Dramamint is a video template and content creation service platform legally operated by TeamPulse Solutions LLC (hereinafter referred to as the "Service Provider"). For detailed information about Dramamint and the Service Provider, please refer to the "Legal Notices" or "About Us" pages on the Dramamint website or application.

1.2 Service Content
Dramamint provides users with creation services based on video templates. Through the templates, materials and related tools provided by the platform, users can generate video content with the same style or effect (hereinafter referred to as the "Services").
The Services may be provided in the following forms:
a) Free Services
b) Paid Services (e.g., membership subscriptions, one-time purchases, etc.)
c) Ad-supported Services
If a service requires a fee, Dramamint will provide a clear prompt to the user prior to use.

1.3 Service Availability
In principle, Dramamint Services are available on various platforms, devices and operating systems supported by the Service Provider. Due to technical reasons, system compatibility, maintenance or other factors, some functions may be restricted on specific devices or system versions, subject to the actual display.

1.4 Registration and Accounts
a) To use some or all of the functions of Dramamint, users may need to register an account.
b) Registration is usually completed through the Dramamint mobile application. During the registration process, users must agree to these Terms and the Privacy Policy.
c) Users may choose to register and log in using a third-party account (e.g., Apple ID, Google Account or other supported third-party platform accounts).
d) Users warrant that all information provided during registration is true, accurate and complete, and shall update such information in a timely manner if any changes occur.
e) User accounts are for the exclusive use of the registered user and shall not be transferred, leased, lent or otherwise made available to third parties.
f) The service contract relationship between the user and the Service Provider shall be established when the Service Provider completes the account registration confirmation or when the user first successfully uses the Services.

1.5 Third-Party Platform Terms
If a user downloads or uses Dramamint through a third-party app store (e.g., Apple App Store, Google Play), or accesses relevant content through a third-party platform, the user shall comply with the relevant terms and policies of such third-party platform in addition to these Terms. In the event of a conflict between the third-party terms and these Terms, these Terms shall prevail.

1.6 Network Fees
All network traffic fees, communication fees and other charges incurred in the process of downloading, installing and using the Dramamint Services shall be borne by the user, subject to the charging standards of the user's network service provider.

1.7 User Eligibility and Usage Restrictions
1.7.1 The prerequisites for using the Dramamint Services are that the user:
a) Has reached the age of 18;
b) Possesses full capacity for civil conduct.
1.7.2 The Dramamint Services are only available to individual users (consumers) and are limited to non-commercial and non-operational use.
1.7.3 Without the prior written permission of the Service Provider, it is strictly prohibited to use the Dramamint Services, templates or generated content for any commercial purposes, including but not limited to commercial promotion, advertising, secondary sales or providing paid services to third parties.
2. Paid Services
2.1 Overview of Paid Services
Some of the Dramamint Services are Paid Services. The scope of services available to a user depends on the type of service selected, including Free Services and Paid Services.
a) Free users may access some basic functions and limited video templates or generation capabilities;
b) Users who subscribe to or purchase Paid Services may unlock more video templates, creation functions, generation times or other premium benefits.
Dramamint will clearly display the price, service content, applicable period, restrictions and relevant terms of all Paid Services within the application. After completing the payment, users may only use the functions and content explicitly listed in the purchased services. All displayed fees include all relevant taxes payable in accordance with the law (if applicable).

2.2 Purchase Process and Contract Formation
The purchase process for Paid Services shall be subject to the prompts within the Dramamint application or the instructions in the third-party app store (e.g., Apple App Store, Google Play).
a) When a user clicks the purchase or subscribe button, it shall be deemed a purchase offer submitted to the Service Provider;
b) Clicking the purchase button alone does not constitute the formation of a contract;
c) The relevant Paid Services contract shall be established upon the user's completion of payment and receipt of the corresponding electronic confirmation (or successful activation of the Paid Services).
Activation of the Services or the user's commencement of use of the paid content may also be deemed as the user's implied confirmation of the purchase.

2.3 Subscription Services and Restrictions on Usage Rights
2.3.1 Dramamint may offer one-time purchase services or subscription services of different durations (e.g., weekly, monthly or annual subscriptions).
2.3.2 Upon successful purchase or subscription, the user is entitled to use the corresponding paid content on devices associated with their app store account and compatible with the Services, limited to personal, non-commercial use only.
2.3.3 Without the prior written permission of the Service Provider, the user shall not:
a) Use the templates, generated videos or relevant content for commercial purposes;
b) Publish, distribute, sell, sublicense or make the content available to third parties (whether for a fee or not);
c) Copy, tamper with, reverse engineer, remove copyright notices or source information;
d) Perform unauthorized re-editing or secondary distribution of the templates or generated content.
The usage right granted to the user is a non-exclusive, non-transferable, non-sublicensable limited right, subject to the user's full payment of all fees. The circumstances of fair use expressly permitted by law are not subject to the restrictions of this Clause.
2.3.4 The Service Provider reserves the right to modify, update, take down or replace the templates or content for technical, legal or content compliance reasons.
2.3.5 The Service Provider shall provide access to or download conditions for the purchased digital content within a reasonable period, but does not guarantee permanent storage or indefinite availability. Users are advised to save the generated or downloaded content by themselves to the extent permitted by law. If the content will no longer be available for download, Dramamint will provide a reasonable advance notice.

2.4 Payment Methods and Third-Party Payment Services
All payment methods displayed within the application are available for use. The payment process is usually processed by a third-party payment service provider or the operator of the app store, including but not limited to Apple, Google or their designated payment systems.
If a third-party payment service provider applies its own terms or usage rules, such terms shall apply only to the payment act itself. If necessary, the user shall register and maintain the corresponding third-party account by themselves.

2.5 Auto-Renewal and Cancellation
Some subscription services may have an auto-renewal mechanism, subject to the app store rules and the instructions on the purchase page:
a) Subscriptions may be automatically renewed at the end of the current period;
b) Users may cancel their subscriptions at any time through the app store account settings;
c) After cancellation, subscription benefits will usually terminate at the end of the current billing period.
For detailed instructions on subscription periods, renewal methods and cancellation rules, please refer to the terms and prompts of the corresponding app store.

2.6 Payment Failure and Service Restrictions
If the fee cannot be successfully deducted due to the user's reasons, the user shall bear all relevant fees incurred thereby. If the paid amount is charged back, withdrawn or not successfully completed, the Service Provider reserves the right to suspend or restrict the user's access to all or part of the Paid Services without further notice.

2.7 Free Trials and Promotional Activities The Service Provider may from time to time offer free trials, discounts or trial-type Paid Services to some users. The participation in such activities, the activity period and the scope of services are all at the sole discretion of the Service Provider. The Service Provider reserves the right to adjust or terminate relevant activities at any time.

2.8 Business Model Adjustments
The Service Provider reserves the right to adjust its business model at any time, including adding, modifying or canceling some Free Services or Paid Services. Relevant adjustments and fee changes will be publicly announced in the Dramamint application in advance. Users may choose whether to continue using the relevant services at their own discretion.

2.9 Recovery of Arrears
The Service Provider reserves the right to claim further rights against the user for unpaid or overdue payments in accordance with the law.

2.10 Platform Support Personnel
The Service Provider may engage platform support personnel (including volunteers or paid staff) to assist users in understanding and using the Dramamint Services. The acts of such personnel do not constitute a personalized creation commitment or commercial agency to the user.
3. Right of Withdrawal
3.1 Scope of Application of the Right of Withdrawal
If a user purchases Dramamint's Paid Services through an app store, the user's right of withdrawal and refund rules shall be subject to the refund policy of the corresponding app store. The Service Provider does not independently process withdrawal or refund requests completed through third-party app stores.

3.2 Consequences of Withdrawal
To the extent permitted by applicable law, if a user lawfully revokes the contractual relationship with the Service Provider, the Service Provider shall refund the corresponding amount paid by the user within no more than fourteen (14) days from the date of receiving the withdrawal notice. Refunds shall be completed through the user's original payment method in principle, without any additional fees charged to the user.
If the user has explicitly requested the immediate provision of services during the withdrawal period, the Service Provider reserves the right to charge a reasonable fee for the part of the services actually provided, which shall be calculated in proportion to the services provided against the total contractual services.
4. User Rights and Obligations
4.1 Scope of Use and Account Obligations
Dramamint and all Services, templates, materials and generated content provided thereby are for the user's personal, non-commercial use only. Without the prior written permission of the Service Provider, users shall not use Dramamint or any of its Services for commercial purposes.
User accounts are for the exclusive use of the registered user and shall not be transferred, leased, lent, shared or licensed to third parties in any form. Users shall keep their account information in strict confidence and be fully responsible for all activities conducted through their accounts.

4.2 Prohibited Conduct
Unless otherwise expressly agreed in these Terms, users shall not engage in the following conduct:
4.2.1 Use Paid Services on multiple terminal devices at the same time, unless explicitly permitted in the relevant service description;
4.2.2 Provide information used for identity verification, login or account identification (including but not limited to account numbers, passwords, verification codes, etc.) to any third party;
4.2.3 Allow third parties to view, access or use the Dramamint Services or content in public or semi-public places, including but not limited to cinemas, exhibitions, conferences, hotels, bars, restaurants, training venues or other public areas;
4.2.4 Bypass, damage, circumvent or attempt to bypass any technical or administrative measures adopted by Dramamint in respect of Paid Services, usage limits, function restrictions or access rights in any form;
4.2.5 Transfer, assign or sublicense all or part of any rights or obligations under these General Terms to a third party.

4.3 Age and Minor Protection
Some or all of the Dramamint Services may only be provided to users who meet specific conditions (e.g., reaching the legal age). Users are responsible for ensuring that themselves or persons allowed to access the Services meet the relevant requirements.
Users specifically warrant to comply with applicable laws and regulations on minor protection, and shall not use Dramamint to generate, disseminate or access any content that may have an adverse impact on the physical and mental health of minors.

4.4 Third-Party Agreements
In the course of using the Dramamint Services, users shall independently comply with the relevant agreements signed with third parties, including but not limited to the terms of internet access service providers, app store operators or payment service providers. Dramamint shall not be liable for any disputes or losses arising from third-party services or agreements.

4.5 Liability for User Content and Conduct
Users shall bear full legal liability for all their conduct on the Dramamint platform and all content generated, uploaded, published or transmitted thereby.
Users warrant to comply with the Content and Conduct Norms of Dramamint, and in particular, shall not generate, upload, disseminate or otherwise use the following content:
a) Racist, hateful, discriminatory, insulting, harassing or defamatory content;
b) Pornographic, vulgar, violent, terrorist or violence-glorifying content;
c) Content that violates laws and regulations, social public order and good morals or infringes upon the legitimate rights and interests of others;
d) Unauthorized use of legally protected names, portraits, voices, images, videos, music, fonts, trademarks or other protected materials;
e) Data containing viruses, malicious code or that may damage system security.
Users are obligated to take reasonable measures to prevent unauthorized use of their accounts, and shall immediately notify the Service Provider if they discover or suspect any abnormality or theft of their accounts.

4.6 Authenticity of Data and Lawful Use
Users warrant not to use another person's identity information falsely, not to intentionally provide false, untrue or misleading data, and not to use third-party payment information (including credit card or bank account information) illegally.
Users shall comply with all applicable laws and regulations when registering, logging in and using the Dramamint Services.
If Dramamint provides chat, comment or messaging functions, users shall keep the relevant communication content in reasonable confidence and shall not disclose such information to the public or to third parties without the explicit consent of the other party, including but not limited to names, contact information, email addresses or website addresses.

4.7 Prohibition of Abuse and Infringing Conduct
Users shall not abuse the Dramamint Services, and in particular, shall not:
a) Publish or disseminate offensive, defamatory or illegal information;
b) Threaten, harass or infringe upon the legitimate rights and interests of other users or third parties (including personality rights, privacy rights, etc.);
c) Upload or use copyrighted software, materials or content unless the user legally holds the relevant rights or has obtained legal authorization;
d) Interfere with or damage the normal operation of the Services or affect the user experience of other users in any way;
e) Attempt to intercept, monitor or obtain system or user data illegally;
5. Liability and Disclaimer
5.1 Nature of Services and Disclaimer
Dramamint provides video creation and generation services based on templates and technical tools, which are only for content creation reference and entertainment purposes.
The Service Provider makes no express or implied warranties with respect to the following matters, including but not limited to:
- The accuracy, completeness, legality or suitability of the generated content for a specific purpose;
- That the generated content will not infringe upon any third party's copyright, portrait right, trademark right or other legitimate rights and interests;
- That the user will achieve specific effects, traffic, income or commercial success through the use of the Services.
The content provided by Dramamint does not constitute any form of legal, copyright, commercial or professional advice.
All risks and consequences arising from the user's generation, use or publication of content based on the Dramamint Services shall be borne by the user alone.

5.2 Technical and Service Availability
Dramamint may experience temporary interruptions, delays or function restrictions due to system maintenance, upgrades, network failures, third-party service interruptions, force majeure or other reasons. The Service Provider does not warrant that the Services will be uninterrupted, error-free or always available.
To the maximum extent permitted by law, the Service Provider shall not be liable for any losses incurred by the user due to the above reasons.

5.3 Limitation of Liability
The Service Provider shall only be liable in the following circumstances:
a) For losses caused by intentional misconduct or gross negligence, the Service Provider shall bear unlimited liability in accordance with the law;
b) For losses caused by a breach of the core obligations necessary for the performance of the contract purpose, the Service Provider shall only bear liability within the scope of ordinary negligence, and the liability shall be limited to foreseeable, typical losses.
Under no circumstances shall the Service Provider's compensation liability for ordinary negligence exceed the total amount actually paid by the user for the relevant Paid Services in the twelve (12) months prior to the occurrence of the loss.
The above limitation of liability shall not apply to:
a) Damage to life, body or health;
b) Guaranteed liability for explicit commitments;
c) Liability that cannot be limited or excluded by mandatory legal provisions (e.g., applicable product liability).
If the Service Provider's liability is excluded or limited, the personal liability of its legal representatives, employees and trustees shall also be excluded or limited to the same extent.

5.4 User Indemnification Obligation
If the Service Provider or its affiliates, employees or agents suffer any claims, losses or expenses (including reasonable attorney's fees) due to the user's breach of these General Terms, applicable laws or infringement of third-party legitimate rights and interests, the user shall indemnify and hold harmless the Service Provider within the scope of their liability.

5.5 Liability for User-Generated Content
Users shall bear full legal liability for all content uploaded, generated, published or used on the Dramamint platform.
Unless otherwise provided by law or agreed in these Terms, the Service Provider shall not conduct prior review of user-generated content, nor shall it be liable for the legality, accuracy or compliance of such content. The Service Provider reserves the right to take measures such as deletion, blocking, restriction or account termination in accordance with the law when discovering illegal, infringing or non-compliant content.
6. Contract Term, Termination and Refunds
6.1 Termination of Free Services
If a user only uses Free Services, the user may terminate the use of the Dramamint Services at any time and may delete the account through the in-application account settings.
If a user breaches these General Terms or applicable laws, the Service Provider reserves the right to immediately suspend or terminate the user's access to all or part of the Services without further notice. The Service Provider also reserves the right to refuse user registration or continued use of the Services without providing a reason.

6.2 Term and Termination of Paid Services
If a user purchases or subscribes to Paid Services, the term, renewal and termination rules of the relevant services shall be subject to the purchase page and the applicable third-party app store terms.
a) Subscription services are usually valid for the agreed billing period;
b) After the user cancels the subscription, the user may continue to use the Services until the end of the current period;
c) If purchased through an app store, the user shall terminate the service through the subscription management function of the corresponding app store.

6.3 Termination for Just Cause
For both Free and Paid Services, either party may immediately terminate the contractual relationship for just cause.
A user's material breach of these General Terms, applicable laws or infringement of third-party rights and interests shall constitute just cause for the Service Provider, without prior warning.

6.4 Refund Rules
Unless otherwise mandated by law or explicitly stated by the Service Provider, fees already paid shall not be refunded in principle after the termination of the contract.
If the contract is terminated in advance due to a material reason for which the Service Provider is liable, the user may claim a corresponding refund in accordance with the law.

6.5 Data Processing
After the termination of the contract, the Service Provider shall delete or anonymize the user's personal data within a reasonable period, except for data that needs to be retained in accordance with the law (e.g., necessary data for compliance, dispute resolution or performance of legal obligations).
7. Final Provisions
7.1 Service Availability and Function Adjustments
The Service Provider shall use reasonable efforts to ensure the stable operation and availability of the Dramamint application and related Services. However, the user understands and agrees that a completely fault-free or uninterrupted service cannot be technically guaranteed for technical reasons.
To the extent permitted by law, the Service Provider makes no warranties with respect to the following:
a) That the application is always available or free of technical failures;
b) That specific functions, templates or services are continuously available at any time;
c) That free functions are available for a long term or permanently.
Unless otherwise expressly agreed, the Service Provider reserves the right to modify, update, restrict, remove or discontinue the provision of all or part of the content, functions or Services of Dramamint at any time, and also reserves the right to launch new content, functions or Services, or discontinue further development of the entire application.
In the case of new services or functions, the Service Provider may formulate and apply separate terms separately.

7.2 Changes to the Terms
The version of the Dramamint Terms of Service in effect at the time the user places an order or uses the Services shall apply.
The Service Provider reserves the right to modify these General Terms with just and objective reasons, including but not limited to the following circumstances:
a) Changes in laws, regulations or judicial precedents;
b) Changes in technical conditions, system architecture or security requirements;
c) Adjustments to service content, functions or business models;
d) Changes in market or operating environment.
If the change to the Terms may have an adverse impact on users, the Service Provider shall notify users at least fourteen (14) days in advance through in-application prompts, website announcements, email or other means.
Users have the right to stop using the Services before the changes take effect. If the user continues to use Dramamint after the new Terms take effect, it shall be deemed that the user has accepted the modified Terms.

7.3 Third-Party Services and Assignment of Rights
The Service Provider reserves the right to entrust third parties to perform all or part of its service obligations on its behalf at any time, including but not limited to technical support, content distribution or payment processing.
In addition, the Service Provider reserves the right to assign all or part of its rights and obligations under these General Terms to a third party in accordance with the law. Such assignment shall not require further user consent on the premise that the legitimate rights and interests of the user are not affected.

7.4 Written Form and Waiver
Any agreement that is inconsistent with, or supplements or modifies these General Terms shall be valid only if made in writing (including electronic form). The Service Provider's failure to assert its rights in individual cases shall not constitute a waiver of such rights.

7.5 Severability Clause
If any clause in these General Terms is deemed invalid, illegal or unenforceable, it shall not affect the validity of the other clauses.
In such case, the parties shall replace the invalid clause with a clause that is legally valid and closest in economic purpose to the intent of the original clause. If there are omissions or unaddressed matters in these General Terms, they shall also be supplemented and interpreted in accordance with the same principle.
